Terms and Conditions
§ 1 Scope of Application
(1) These Terms and Conditions (hereinafter "T&C") apply to all contracts concluded via our website www.lebeninzypern.com between us, Living in Cyprus, and you as our customer.
(2) The version of the T&C valid at the time of contract conclusion shall be decisive.
(3) We do not accept deviating conditions from the customer. This also applies if we do not expressly object to their inclusion.
§ 2 Subject of Contract
(1) We offer various services in the field of consulting and support for emigrants, company formation, real estate brokerage, interpreter services, and car rental brokerage in Cyprus.
(2) The exact scope of the respective service results from the individual agreement with the customer.
§ 3 Contract Formation
(1) The presentation of our services on the website does not constitute a legally binding offer, but an invitation to submit an offer.
(2) By submitting an inquiry via our contact form, you make a binding offer to conclude a contract.
(3) We can accept your offer within 5 working days by sending an order confirmation via email. After the fruitless expiry of this period, your offer is deemed rejected.
§ 4 Prices and Payment Terms
(1) The prices valid at the time of ordering apply. All prices are in euros and include statutory VAT.
(2) Payment is made by bank transfer or other agreed payment methods as agreed.
(3) In case of payment default, we are entitled to charge default interest of 5 percentage points above the base rate.
§ 5 Service Provision
(1) We provide our services with due care and to the best of our knowledge and belief.
(2) Dates and deadlines for service provision are only binding if they have been expressly confirmed by us in writing.
(3) The customer is obliged to provide us with all information necessary for service provision in a timely manner.
§ 6 Liability
(1) We are liable without limitation for intent and gross negligence as well as in accordance with the Product Liability Act. For slight negligence, we are only liable in case of violation of an essential contractual obligation (cardinal obligation).
(2) In case of violation of a cardinal obligation, our liability is limited to the foreseeable, contract-typical damage.
(3) The above liability limitations do not apply in case of injury to life, body, or health.
§ 7 Right of Withdrawal for Consumers
(1) Consumers have a statutory right of withdrawal. We inform about the conditions, deadlines, and procedures for exercising the right of withdrawal in our withdrawal instruction.
(2) The right of withdrawal does not exist for contracts for the provision of services if we have completely provided the service and only began executing the service after the consumer has given their express consent and at the same time confirmed their knowledge that they lose their right of withdrawal upon complete contract fulfillment by us.
§ 8 Data Protection
(1) We process personal data of the customer to carry out the contract. Further information can be found in our privacy policy.
(2) The customer agrees that their personal data may be stored and processed for contract execution.
§ 9 Dispute Resolution
(1) The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/
(2) We are not willing or obliged to participate in dispute resolution procedures before a consumer arbitration board.
§ 10 Final Provisions
(1) The law of the Republic of Cyprus applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) If the customer is a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is our business location in Paphos, Cyprus.
(3) Should individual provisions of these T&C be or become invalid, this does not affect the validity of the remaining provisions.
